The recommendations for Thai Government in order to  provide assistance to Thai people remaining in Malaysia by the Ad Hoc Committee for Association of the Medical Crescent and Public Health to help Thai people Remaining in Malaysia – (the Committee) (13 April 2020)

As the Committee has been following the situation and problems experienced by Thai people in Malaysia caused by a Covid-19 pandemic, a movement controls order and a lockdown in Malaysia. The Committee would like to make our recommendations to Thai government to help Thai people in Malaysia; especially Thai workers who are in their hardship as follows:

1.         Thai Government should assist and facilitate Thai people who would like to return to Thailand after the lockdown measure issued by Malaysian Government. It is likely that this measure will be extended for the next few months. In addition, the Malaysian Government has a tendency to reorganize migrant worker management after the Covid-19 crisis. As a consequence, Thai workers need to stop working, lack of income and are left in destitution. They are now scared and are uncertain about their future; therefore, they would like to return to Thailand.

According to Section 39 of the Constitution of Thailand, “It is prohibited to expel Thai citizens outside the Kingdom or to prevent Thai citizens from entering the Kingdom”. The Government must not put more burden or violating their rights and liberties of that person more than is necessary (Section 26 of the Constitution).

The Committee; therefore, would like to make these recommendations to the Thai Government in order to help and facilitate Thai people in Malaysia who would like to return to Thailand.

1.1       The Government of Thailand should revoke the use of medical certificate which guarantees that a person is fit to fly. It said this fit-to-fly certificate must be issued 72 hours prior the flight. This has created an enormous burden to Thai workers who would like to return home as many of them do not have access to medical center and do not have money to pay for a certificate. Furthermore, the number of medical center who could issue the certificate is limited and the center is not available in all states. Even though, the certificate states that the person is fit to travel, it does not mention anything about Covid-19 contraction.

1.2       The Government should extend time indicated that people should arrive at the border checkpoint. It has been indicated that people should arrive at the border checkpoint before noon. However, for people who are from states that are far from the border checkpoint, it is unlikely that they could not make it. Apart from far distance, it is very difficult to travel between states or cities during the Movement Control Order (MCO) since there are many checkpoints. In addition, it may be against the MCO to travel at night.

1.3       The Government should facilitate the workers to travel to the border checkpoint by hiring a bus in Malaysia to transport them to the border every day. This is due to the fact that public transportation has terminated the operation and it is expensive to hire a bus/van in Malaysia and the service providers usually overcharge for such services. More importantly, most Thai workers do not have enough money to organize a trip by themselves.

2.         The Committee would like to recommend that Thai Government should provide food supplies to Thai workers more effectively. The Government, without any delay, should provide assistance to the workers in Malaysia as urgently, systematically and organized as possible.

Thai Embassy and Consular in Malaysia might not have enough capacity to help all Thai workers. This assistance could be cooperated with assistance from the bilateral national policy level. 

The Thai Prime Minister should request for assistance from Malaysian Prime Minister to send food supplies to Thai workers via air.

He also should ask Malaysian Government to help distributing them by using its personnel in the area, such as police, military and volunteer.

Thai Government should put the names of Thai people who need help together in a list, hand it to Malaysian Government and follow up with the latter government closely and systematically.

3.When the workers arrive in Thailand, the Government should organize a place for quarantine and facilitate to bring them to the prepared locality. The fact that the Thai Government cannot organize a quarantine place for those arrived shows that the Government might have failed to manage Covid-19 situation.

The Government could increase the quarantine centers by using many hotel accommodations or local facilities in Su-gnai golok district and area outside the checkpoint, Sadao district, and Songkla Province. More importantly, the Thai Government should pay the persons in quarantine minimum wage which would help ease their situation.

ข้อเสนอต่อรัฐบาลในการช่วยเหลือคนไทยที่ตกค้างในประเทศมาเลเซีย

โดยคณะกรรมการเฉพาะกิจสมาคมจันทร์เสี้ยวการแพทย์และสาธารณสุขเพื่อร่วมช่วยเหลือคนไทยในประเทศมาเลเซีย (คฉ.จม.)

ตามที่ คณะกรรมการเฉพาะกิจสมาคมจันทร์เสี้ยวการแพทย์และสาธารณสุขเพื่อร่วมช่วยเหลือคนไทยในประเทศมาเลเซีย (คฉ.จม.) ได้ติดตามปัญหาความเดือดร้อนของพี่น้องคนไทยในมาเลเซียจากการแพร่ระบาดของโควิด 19 และมาตรการควบคุมการเดินทาง (Movement Control Order – MCO) หรือการล็อคดาวน์ (lockdown) ของมาเลเซีย คฉ.จม. มีข้อเสนอต่อรัฐบาลในการช่วยเหลือคนไทยในมาเลเซีย โดยเฉพาะแรงงานไทย ซึ่งเป็นผู้มีฐานะยากจนข้นแค้น ดังนี้

1) ข้อเสนอต่อการช่วยเหลือและอำนวยความสะดวกแก่คนไทยที่ต้องการเดินทางกลับประเทศ

จากการ lockdown ของมาเลเซียที่มีแนวโน้มจะขยายต่อไปอีกหลายเดือน และแนวโน้มที่มาเลเซียจะจัดระบบแรงงานต่างชาติใหม่หลังโควิด 19 ทำให้แรงงานไทยซึ่งต้องหยุดงาน ขาดเงิน และเริ่มเข้าสู่ภาวะอดอยาก เกิดความรู้สึกหวาดกลัว ไม่มั่นใจในอนาคต จึงต้องการเดินทางกลับประเทศไทย  ทั้งนี้ การเดินทางเข้าประเทศของคนไทยเป็นสิทธิตามรัฐธรรมนูญ ดังที่ว่า “การเนรเทศบุคคลสัญชาติไทยออกนอกราชอาณาจักร หรือห้ามมิให้ผู้มีสัญชาติไทยเข้ามาในราชอาณาจักร จะกระทำมิได้” (มาตรา 39 ของรัฐธรรมนูญ) และรัฐจะต้องไม่เพิ่มภาระหรือจำกัดสิทธิและเสรีภาพนี้ของบุคคลเกินสมควรแก่เหตุ (มาตรา 26 ของรัฐธรรมนูญ)  คฉ.จม. จึงขอเสนอให้รัฐบาลช่วยเหลือและอำนวยความสะดวกแก่คนไทยในมาเลเซียที่ต้องการเดินทางกลับไทย ดังนี้

1.1) ยกเลิกการใช้ใบรับรองแพทย์ (fit to travel)

ที่ผ่านมาข้อกำหนดเรื่องใบรับรองแพทย์ที่ระบุข้อความ fit to travel ซึ่งต้องออกภายใน 72 ชั่วโมงก่อนการเดินทาง ได้สร้างภาระอย่างมากให้แก่แรงงานไทยที่ต้องการกลับบ้าน เพราะแรงงานจำนวนมากเข้าไม่ถึงสถานพยาบาล ไม่เงินจ่ายค่าออกใบรับรอง สถานพยาบาลที่สามารถออกใบรับรองแพทย์ได้มีจำกัด และมีไม่ครบทุกรัฐ อีกทั้งในใบรับรองแพทย์ที่แม้จะระบุคำว่า fit to travel ก็ไม่สามารถบ่งชี้ภาวะการติดโรคโควิด 19 ได้แต่อย่างใด

1.2) ขยายการกำหนดเวลาการเดินทางมาถึงด่านชายแดน

ข้อกำหนดที่ระบุให้ผู้ผ่านแดนต้องเดินทางมาถึงที่ด่านชายแดนก่อนเวลา 12.00 น. นั้น หากเป็นผู้ที่อยู่ในรัฐที่อยู่ห่างไกลจากด่านชายแดนนั้นแทบจะทำตามไม่ได้เลย นอกจากระยะทางที่ห่างไกลแล้ว การเดินทางข้ามเมือง/รัฐในช่วง MCO ยังเป็นไปด้วยความลำบาก เพราะมีการตรวจตราจากเจ้าหน้าที่มากมายหลายด่าน อีกทั้งการเดินทางกลางคืนหรือแวะพักระหว่างก็อาจผิดคำสั่ง MCO ได้

1.3)  อำนวยความสะดวกการเดินทางมายังด่านชายแดน

รัฐบาลโดยสถานเอกอัครราชทูตฯ และสถานกงสุลไทยในมาเลเซีย ควรต้องอำนวยความสะดวกในการเดินทางมายังด่านชายถาวรแดนแดนโดยการเช่าเหมารถบัสในประเทศมาเลเซียบริการมาส่งผู้ข้ามแดนยังด่านต่างๆ ทุกวัน เนื่องตอนนี้รถประทางหยุดวิ่ง ต้องใช้การจ้างเหมาที่มีราคาแพง นายหน้าผู้จัดการเดินทางมักเก็บค่าเดินทางแพงเกินจริง ที่สำคัญแรงงานไทยส่วนใหญ่ไม่มีเงินเหลือพอสำหรับการเดินทางด้วยตนเองอีกแล้ว

2) ข้อเสนอในการช่วยเหลือบรรเทาทุกข์ด้านเสบียงอาหารแก่แรงงานไทย

รัฐบาลไทยต้องเร่งนำความช่วยเหลือเข้าไปในมาเลเซียอย่างเร่งด่วนและเป็นระบบ กลไกสถานเอกอัครราชทูตฯ และสถานกงสุล ที่ทำอยู่นั้น ไม่มีศักยภาพพอที่จะช่วยเหลือแรงงานไทยได้อย่างทั่วถึง การช่วยเหลือต้องอาศัยความร่วมมือระดับประเทศ โดยนายกรัฐมนตรีของไทยต้องขอความช่วยเหลือโดยตรงจากนายกรัฐมนตรีมาเลเซียในการขอส่งเสบียงอาหารทางเครื่องบินมาให้แก่แรงงานไทย รวมทั้งขอให้ทางการมาเลเซียช่วยกระจายสิ่งของบรรเทาทุกข์ให้แก่คนไทยโดยใช้กลไกแนวหน้ามาเลเซียที่คุมพื้นที่ทั้งหมดอยู่ ได้แก่ ตำรวจ ทหาร และ อาสาสมัคร  ทั้งนี้ ระดับปฏิบัติการของฝ่ายไทยต้องมีรายชื่อและจำนวนผู้เดือดร้อนที่ชัดเจนและประสานงานกับทางมาเลเซียอย่างเป็นระบบและใกล้ชิด

3) ข้อเสนอในการกักตัวเมื่อเดินทางมาถึงไทย

รัฐบาลไทยต้องจัดเตรียมสถานที่กักตัวผู้เดินทางกลับให้ได้พร้อม และอำนวยความสะดวกในการเดินทางจากด่านฝั่งไทยไปยังสถานที่กักตัว การไม่สามารถจัดหาสถานที่กักตัวรองรับผู้เดินทางกลับได้เพียงพอถือว่าเป็นความล้มเหลวของรัฐบาลในการบริหารจัดการสถานการณ์โควิด 19 ทั้งนี้ รัฐสามารถเพิ่มสถานที่กักตัวโดยใช้โรงแรมต่างๆ ในอำเภอสุไหงโก-ลกและบริเวณด่านนอก อำเภอสะเดา จังหวัดสงขลา ที่สำคัญ รัฐควรจ่ายเบี้ยเลี้ยงเท่ากับค่าแรงขั้นต่ำให้กับผู้ที่กักตัวด้วย อันจะเป็นการช่วยเหลือบรรเทาความเดือดร้อนของพวกเขาได้ในทางหนึ่ง
