แถลงการณ์ มูลนิธิผสานวัฒนธรรม ขอประณามกลุ่มติดอาวุธ กรณีสังหารพลเรือน ปล้นรถยนต์ ในจังหวัดสงขลาเพื่อทำคาร์บอมบ์ ขอให้ฝ่ายความมั่นคงใช้ขันติธรรมและไม่สมควรโต้ตอบด้วยความรุนแรง

ขอประณามกลุ่มติดอาวุธ

กรณีสังหารพลเรือน ปล้นรถยนต์ ในจังหวัดสงขลาเพื่อทำคาร์บอมบ์

ขอให้ฝ่ายความมั่นคงใช้ขันติธรรมและไม่สมควรโต้ตอบด้วยความรุนแรง

จากสถานการณ์การปล้นรถยนต์ในพื้นที่อ.เทพาและอ.นาทวี จังหวัดสงขลา เมื่อวันที่ 16 สิงหาคม 2560และทางราชการสามารถติดตามนำรถที่ปล้นได้ทั้งหมดจำนวน 7 คันแล้วเมื่อวันที่ 17 สิงหาคม 2560  โดยทางการเชื่อว่าเป็นการทำแผนประทุษกรรมและการก่อความไม่สงบโดยกลุ่มบุคคลเชื่อว่ามีความสัมพันธ์กับกองกำลังติดอาวุธ ในจังหวัดชายแดนใต้ อย่างน้อย 6 คน  ปฏิบัติการดังกล่าวเริ่มจากที่กลุ่มบุคคล ได้ใช้บุกปล้นรถยนต์กระบะอีก 6 คัน จากเต๊นท์รถยนต์มือสองในอำเภอนาทวี จังหวัดสงขลา ซึ่งเป็นรอยต่อกับสามจังหวัดชายแดนใต้ พร้อมทั้งได้จับตัวพนักงานเต๊นท์รถยนต์ไป 4 คน แล้วทำร้ายเพื่อมุ่งสังหารพนักงานดังกล่าวอย่างโหดเหี้ยม จนทำให้เสียชีวิต 1คน และกลุ่มผู้ก่อเหตุเสียชีวิต 1 คน   ทางการมีหลักฐานเชื่อว่ารถที่ปล้นกำลังจะนำไปบรรทุกระเบิดเป็นคาร์บอมบ์     โดยรถจำนวน 2 ใน 7 คันเกิดเหตุระเบิดขึ้นอย่างรุนแรงแต่จากการทำงานของเจ้าหน้าที่ทำให้เกิดความเสียหายในวงจำกัดทั้งต่อชีวิตและทรัพย์สิน มูลนิธิผสานวัฒนธรรมมีความเห็นต่อสถานการณ์นี้ดังนี้

1. ขอแสดงความเสียใจต่อครอบครัวของผู้เสียชีวิต ผู้บาดเจ็บ และผู้ที่สูญเสียทรัพย์สินจากเหตุการณ์ครั้งนี้
2. ขอประนามกลุ่มติดอาวุธ โดยเห็นว่า การใช้กำลังปล้นเต๊นท์รถยนต์และสังหารพนักงานซึ่งเป็นพลเรือนที่ไม่เกี่ยวข้องกับการสู้รบนั้นเป็นการก่ออาชญากรรมที่ร้ายแรงต่อชีวิตและทรัพย์สินของประชาชนผู้บริสุทธิ์ และจากกรณีที่ผ่านมาที่กลุ่มติดอาวุธได้ปฏิบัติการในลักษณะเดียวกันหลายครั้งในจังหวัดชายแดนใต้ อย่างกว้างขวาง และเป็นระบบ ถือว่าเป็นการก่ออาชญากรรมต่อมนุษยชาติ ที่ผู้นำของกลุ่มติดอาวุธและผู้ปฏิบัติการจะต้องถูกนำตัวมาลงโทษตามกฎหมาย ทั้งกฎหมายในประเทศและกฎหมายระหว่างประเทศ
3. ขอเรียกร้องให้ทุกฝ่ายที่เป็นคู่ขัดแย้งด้วยอาวุธเจรจาและทำข้อตกลง ที่มีผลในการปฏิบัติอย่างแท้จริง เพื่อยุติการโจมตีพลเรือนที่ไม่เกี่ยวข้องกับการสู้รบ โดยเฉพาะหญิงและเด็ก รวมทั้งบุคคลากรและสถานที่ที่เกี่ยวกับงานด้านมนุษยธรรม เช่นโรงเรียน สถานพยาบาล ศาสนสถาน พร้อมทั้งกำหนดเป้าหมายและพื้นที่ปลอดภัยโดยต้องได้รับการเคารพและยึดถือปฏิบัติจากทุกฝ่ายอย่างเคร่งครัด
4. ขอให้เจ้าหน้าที่ดำเนินการเอาตัวคนร้ายมาลงโทษ โดยยึดถือปฏิบัติตามกระบวนการยุติธรรมอย่างเคร่งครัด อีกทั้งทางหน่วยงานฝ่ายความมั่นคงใช้ขันติธรรมและไม่สมควรโต้ตอบด้วยความรุนแรง ละเมิดสิทธิมนุษยชนและการใช้ภาษาที่แสดงถึงความเกลียดชังที่เป็นการสร้างให้เกิดวงจรความรุนแรง
5. ขอเรียกร้องให้ผู้นำกลุ่มติดอาวุธแสดงความรับผิดชอบต่อการกระทำดังกล่าว และทำให้ประชาชนมั่นใจว่า เหตุการณ์ในลักษณะเช่นนี้จะไม่เกิดขึ้นอีก
6. ขอให้หน่วยงานของรัฐเยียวยาผู้ที่สูญเสียและเสียหาย ทั้งในด้านทรัพย์สิน ชีวิต และร่างกาย และให้มีมาตรการการคุ้มครองแก่พลเรือนอย่างได้ผล
7. ขอให้ประชาชน ชุมชน ภาคประชาสังคม และกลุ่มองค์กรต่างๆ เฝ้าระวังการก่อเหตุร้ายไม่ว่าจะเกิดขึ้นจากฝ่ายใด และใช้มาตรการอย่างเหมาะสม ในการป้องกัน หรือคัดค้านการก่อเหตุร้ายดังกล่าว

Armed Group Condemned for Killing Civilians

Stolen Cars from Songkhla used as car bombs

Security forces urged to observe tolerance and refrain from violent retaliation

Cars were stolen in Thepha District, Songkhla on16 August 2017. Seven of them have been retrieved by the authorities on 17 August 2017.It was believed the cars were to be used to perpetrate violence and insurgency by at least six members of an armed groups in the Southern Border Provinces of Thailand. It started with the stealing of six pickup trucks from a secondhand car sales tent in Nathawee District, Songkhla, adjacent to the SBPs. Four salespersons of the tent were also kidnapped and then one brutally killed. One member of the armed group was killed and other escaped. Evidence obtained by the authorities suggests that the stolen cars were intended to for use as car bombs. Two of the seven cars have exploded violently. But given the immediate response from the authorities, damages on lives and properties have been vastly controlled. The Cross Cultural Foundation (CrCF) has the following opinions on the situation.

1. We offer our deepest condolences to families of the deceased, the injured and those who suffer lost of lives and property damage.

2. We condemn the armed group viewing that the use of force to raid and steal from the cars sales booth and to kill the civilian was an crime against lives and properties of innocent persons. Until now, the armed group has carried out similar operations repeatedly, extensively and systematically in the SPBs and it should constitute a crime against humanity. Leaders and members of the armed groups and the perpetrators must be brought to justice according to domestic and international laws.

3. We urge all parties in the armed conflicts to negotiate and reach a peaceful and effective solution in order to bring to a halt attacks against civilians, particularly women and children as well as personnel and facilities for humanitarian purpose such as schools, medical facilities, religious sites, etc. Safe zone should be established with clear goals to ensure respect of the people and the places and this should be strictly adhered to by all parties.

4. The authorities should ensure that the perpetrators be brought to justice by upholding strictly the rule of law and justice process. Security forces are also urged to observe tolerance and refrain from violent retaliation, human rights violations and the use of language that perpetuate hatred and the cycle of violence.

5. Leaders of the armed groups are urged to show their responsibilities to such acts and to ensure public that such incidences shall not happen again.

6. The authorities are urged to provide remedies to the families of the deceased and any losses of lives and properties and to put in place an effective measure to protect civilians.
7. The public, community, civil society and all groups are urged to monitor violent incidences abetted by any parties and to help put in place appropriate measures for the prevention and opposition of such harmful incidences.
