Bomb attack at a Pattani’s mall should be condemned while security was lax

Possible Crime Against humanity, condolence to those suffering the losses

All parties are urged to adhere to tolerance and a nonviolent solution

On 9 May 2017, around 14.00, two bombs exploded at a shopping mall in Pattani Province. The first bomb exploded inside the building and the second car bomb, which was triggered a little later on, exploded in the parking lot where many panicked had run into from inside the building after the first bomb. It has thus caused as many as 60 injuries with no death. Several injured persons managed to return home. The powerful bombs, however, have caused massive damage to properties of the mall and the shoppers. They have brought about such terrifying atmosphere.

The incidence stands an indication to at least two major problems. First, a lax security measure in public places and a lack of protection measure for the innocent, in particular, women and children. Second, the violence was aimed deliberately and indiscriminately at innocent population. The detonation of bombs in a public place is a grave violation of international human rights law and international humanitarian law. It could constitute an act of crime against humanity deserving condemnation from all parties. And should it take place systematically, it could be construed as a crime against humanity with the criminal responsibility through international justice system.

According to national law, each state is obliged to bring to justice the perpetrators for the violation of human rights. Both problems need to be tackled urgently since all innocent civilian populations living in an armed conflict must be protected from armed violence from whatever parties.

The Cross Cultural Foundation (CrCF) would like to offer our deepest condolence to those who have been affected by the violent incidence. We condemn those who were behind the bomb attack and who have caused such violence to the civilians including children and women. We also demand that;

1. All armed groups should refrain from abetting armed violence and violent insurgency which may cause the injuries and the loss of lives among innocent people and damage to private and public properties.

2. The state and concerned authorities have to bring to justice the perpetrators through a fair trial with respect to human rights.

3. The state and concerned authorities should help those who have lost their properties or have got injured as well as help to fully provide for mental rehabilitation of those affected by the bomb attack in both short term and long term.

4. The state in collaboration with civil society should mete out measures to protect innocent populations, particularly women and children. They should be protected from armed violence from any parties. All parties are also urged to observe tolerance and explore solutions based on nonviolence.

ประณามระเบิดที่ห้างสรรพสินค้าที่ปัตตานี รักษาความปลอดภัยหละหลวม

อาจเข้าข่ายอาชญกรรมต่อมนุษยชาติ (Crime against humanity)

แสดงความเสียใจต่อความสูญเสีย ขอเสนอแนะให้ทุกฝ่ายอดทนอดกลั้น ยึดมั่นแนวทางสันติ

 เมื่อวันที่ 9 พฤษภาคม 2560 เวลาประมาณ 14.00 น. มีเหตุการณ์ระเบิดขึ้นสองครั้งที่ห้างสรรพสินค้าแห่งหนึ่งในปัตตานี โดยครั้งแรกเกิดขึ้นในตัวอาคารด้านในและครั้งที่สองเวลาไล่เลี่ยกันเกิดขึ้นที่ด้านนอกบริเวณลานจอดรถทำให้ประชาชนที่หลบหนีเหตุร้ายจากภายในห้างฯ ได้รับบาดเจ็บจำนวนมากถึงกว่า  60 ราย แม้ว่าจะไม่มีผู้เสียชีวิตจากเหตุการณ์และผู้บาดเจ็บหลายรายสามารถเดินทางกลับบ้านได้  แต่แรงระเบิดอานุภาพสูงทำให้เกิดความสูญเสียทรัพย์สินของห้างฯและของประชาชนเป็นจำนวนมาก รวมทั้งสร้างความหวาดกลัวต่อประชาชนเป็นอย่างมาก

เหตุการณ์ดังกล่าวสะท้อนให้เห็นสภาพปัญหาสำคัญสองประการคือการรักษาความปลอดภัยในพื้นที่สาธารณะที่หละหลวมและขาดมาตรการการคุ้มครองผู้บริสุทธิ์โดยเฉพาะอย่างยิ่งเด็กและสตรี    อีกประการหนึ่งเหตุรุนแรงดังกล่าวเป็นการกระทำโดยตรงต่อผู้บริสุทธิ์โดยไม่เลือกเป้าหมาย การลอบวางระเบิดในที่สาธารณะเป็นการละเมิดสิทธิมนุษยชนกฎหมายมนุษยธรรมระหว่างประเทศ และเป็นการกระทำความผิดทางอาญาทั้งตามกฎหมายระหว่างประเทศและกฎหมายในประเทศ โดยอาจเป็นความผิดฐานก่ออาชญากรรมต่อมนุษยชาติอีกด้วย จึงควรถูกประนามจากทุกฝ่าย และหากเกิดขึ้นอย่างเป็นระบบอาจเข้าข่ายการก่ออาชญกรรมต่อมนุษยชาติที่ต้องรับผิดทางอาญาตามระบบยุติธรรมระหว่างประเทศ

ทั้งนี้ในกรอบกฎหมายในประเทศรัฐมีหน้าที่ต้องนำตัวผู้กระทำผิดมาดำเนินคดีและรับโทษตามกฎหมายและหลักการด้านสิทธิมนุษยชน  ปัญหาทั้งสองประการต้องได้รับการแก้ไขโดยเร่งด่วนเนื่องจากพลเรือนผู้บริสุทธิ์ในสถานการณ์ความขัดแย้งทางอาวุธต้องได้รับการคุ้มครองจากการใช้อาวุธไม่ว่าจากฝ่ายใด

มูลนิธิผสานวัฒนธรรมขอแสดงความเสียใจต่อผู้สูญเสียในเหตุการณ์ความรุนแรงที่เกิดขึ้น และขอประนามผู้ก่อเหตุระเบิดดังกล่าวซึ่งได้ก่อความรุนแรงต่อพลเรือน เด็กและสตรีผู้บริสุทธิ์  โดยขอเรียกร้องให้

มูลนิธิผสานวัฒนธรรมขอเรียกร้องดังนี้

1. กลุ่มติดอาวุธไม่ว่าฝ่ายใดต้องหลีกเลี่ยงการใช้อาวุธประหัตประหารและก่อเหตุรุนแรงที่อาจส่งผลให้เกิดการบาดเจ็บและเสียชีวิตของประชาชนผู้บริสุทธิ์ ตลอดจนทรัพย์สินของประชาชนและสาธารณะ
2. รัฐและหน่วยงานที่เกี่ยวข้อต้องนำผู้กระทำผิดเข้าสู่กระบวนการยุติธรรมตามหลักกฎหมายและหลักการด้านสิทธิมนุษยชน
3. รัฐและหน่วยงานที่เกี่ยวข้อต้องช่วยเหลือต่อผู้เสียหายทั้งทรัพย์สินและผู้ได้รับบาดเจ็บ รวมทั้งการฟื้นฟูสภาพจิตใจของผู้ได้รับผลกระทบจากเหตุระเบิดอย่างเต็มที่ ทั้งในระยะสั้นและในระยะยาว
4. รัฐต้องประสานงานภาคประชาสังคมในการปกป้องคุ้มครองพลเรือน ผู้บริสุทธิ์โดยเฉพาะเด็กและสตรี ให้ได้รับการคุ้มครองจากการใช้อาวุธไม่ว่าจากฝ่ายใด และทุกฝ่ายต้องมีความอดทนอดกลั้นที่ผู้บริสุทธิ์ และหาทางแก้ไขปัญหาความขัดแย้งด้วยแนวทางสันติวิธี
